Foreign Marriage Certificate Translation in Belgium: Everything You Need to Know

Translating a foreign marriage certificate in Belgium is an essential step in many situations: family reunification, civil marriage with a foreign partner, survivor's pension, inheritance or proof of marital ties with the Belgian authorities. This guide explains when this translation is mandatory, what it must contain and how to order it efficiently.

Why translate a foreign marriage certificate in Belgium

In Belgium, public authorities, municipalities, courts and social organisations require that every official foreign document be accompanied by a sworn translation in order to be legally valid. A marriage certificate drafted in Arabic, Turkish, Romanian or any other foreign language cannot be used directly in a Belgian procedure without this certified translation.

The most common situations requiring the translation of a foreign marriage certificate are:

  • Family reunification: a foreign national legally residing in Belgium wishes to bring their spouse to the country. The translated marriage certificate is the proof of family ties required by the Immigration Office (DVZ/OE).
  • Civil marriage in Belgium with a foreign partner: the municipality where the marriage will be celebrated systematically requests the birth certificate and any previous marriage certificate (to prove single status or divorce) of the foreign partner, translated and sworn.
  • Survivor's pension: after the death of a spouse, proof of marriage is necessary to obtain the survivor's pension from the National Pensions Office (ONP/RVP). The translated foreign marriage certificate is mandatory.
  • Succession and inheritance: a Belgian notary handling an international succession will request the translation of marriage certificates to establish the rights of heirs.
  • Belgian naturalisation: the nationality file includes the complete civil status of the applicant, which encompasses their marriage certificate if applicable.
  • Legal proceedings: divorce, child custody, adoption: Belgian courts require sworn translations for all foreign civil status documents produced as evidence.

In all these situations, only a translation produced by a sworn translator registered with a Belgian Court of Appeal has legal value. A non-certified translation, however linguistically accurate, will be refused.

When sworn translation is mandatory

The general rule in Belgium is straightforward: any foreign document presented to a public authority (municipality, court, social administration, notary) must be accompanied by a sworn translation into one of the country's three official languages (French, Dutch or German).

There is, however, an important nuance related to European regulation. For citizens of the European Union, Regulation (EU) 2016/1191 provides for the removal of legalisation and translation requirements for certain civil status documents through standardised multilingual forms. This means that marriage certificates from Romanian, Polish, French or other EU nationals can, in certain cases, be accepted without a sworn translation if the multilingual form is attached.

In practice, however, many Belgian municipalities and certain authorities continue to require a sworn translation even for EU documents. It is therefore strongly recommended to check with the receiving body before assembling your file.

For nationals of non-EU countries: Morocco, Algeria, Turkey, DRC, Senegal, Guinea, Pakistan, Afghanistan and all other third countries, sworn translation is systematically mandatory without exception.

Practical advice

For family reunification and files at the Immigration Office, always request a sworn translation even if the European regulation would theoretically exempt you. The Immigration Office applies its own criteria and an incomplete file leads to additional delays.

Related documents often required

The translation of the marriage certificate is rarely the only document in an administrative file. Depending on your procedure, you will often need to have other civil status documents translated at the same time to put together a complete and coherent file.

The documents frequently requested alongside the marriage certificate are:

  • Birth certificate of the applicant and/or the spouse: required in almost all immigration, civil marriage and naturalisation procedures
  • Divorce certificate: if either partner was previously married, proof of divorce is mandatory for a new civil marriage in Belgium
  • Birth certificates of common children: for family reunification applications that include children
  • Certificate of civil status or certificate of marriageability: some countries require such a document to be produced by the future foreign spouse before the civil marriage in Belgium
  • Adoption or recognition judgement: where applicable, to establish legal filiation
  • Criminal record extract: required for family reunification files and long-stay visas in certain situations

TranslateBE can process all of these documents in a single order, which simplifies the management of your file and ensures consistent turnaround times across all documents.

It is also important to note the question of legalisation or apostilleprior to translation. For certain countries, the marriage certificate must first be legalised or apostilled in the country of origin before being translated in Belgium. This is particularly the case for Moroccan, Algerian and Congolese documents. Our team will provide you with the exact procedure according to your country of origin when you request a quote.
