Polish-French Translation in Belgium: Guide for Polish Residents

The Polish community in Belgium

Polish immigration in Belgium is a relatively recent large-scale phenomenon, though its roots go back to the Second World War and the post-communist period. It was the enlargement of the European Union in 2004 that truly opened the floodgates: from May 2004, Polish nationals obtained freedom of movement and freedom to work within the European area, and many chose Belgium for its geographical proximity, attractive wages and opportunities in construction, logistics, elderly care and agriculture.

Today, the Polish community in Belgium is estimated at between 70,000 and 100,000 people, with a particularly strong presence in Brussels (where many Poles work in the European institutions or in the service sector), in Limburg and Hainaut (construction and logistics), and in East Flanders. Belgium hosts the fourth largest Polish community in Western Europe, after the United Kingdom, Germany and the Netherlands.

The distinctive feature of the Polish community is that many of its members are in Belgium for economic reasons but maintain their official residence in Poland. Polish documents frequently translated in Belgium

Polish documents have their own administrative characteristics and specific official terminology. Here are the documents most often submitted for sworn translation in Belgium, with their official Polish names.

• Odpis aktu urodzenia (birth certificate extract): issued by the USC (Urząd Stanu Cywilnego, civil registry). Two versions exist: the odpis skrócony (abbreviated version) and the odpis zupełny (full version). Belgian municipalities and the Immigration Office generally prefer the odpis zupełny as it contains more information on parentage. Since 2015, Poland has been issuing multilingual extracts in the standard EU format (Regulation 2016/1191), which are theoretically usable without translation in other Member States. In practice, however, many Belgian administrations continue to require sworn translation.
• Świadectwo ślubu (marriage certificate): also issued by the USC. Essential for family reunification procedures, survivor's pension applications and inheritance matters. As with the birth certificate, a multilingual format has been available since 2018, but sworn translation is still often required.
• Dyplom ukończenia studiów (university degree) and suplement do dyplomu (diploma supplement): Polish degrees must be translated for academic recognition in Belgium. The diploma supplement (the equivalent of the European Diploma Supplement) specifies the teaching units, ECTS credits and the classification of the degree within the Polish system.
• Zaświadczenie o niekaralności (criminal record): issued by the Krajowy Rejestr Karny (National Criminal Register). This document is required for Belgian naturalisation applications and for regulated professions (healthcare, private security, education). It must generally be recent (less than 3 months) at the time the file is submitted.
• Świadectwo szkolne (school report): for Polish children entering the Belgian school system, a translation of the report or certificate enables the school to place them at the appropriate level.
• Umowa o pracę (Polish employment contract): for posted workers or those who wish to demonstrate professional experience gained in Poland for a position in Belgium.
• Akt notarialny (notarial deed): for inheritance proceedings involving real estate in Poland, or for powers of attorney and mandates.

An important point: Poland is a member of the Hague Convention of 1961 on apostilles. Polish documents can therefore be apostilled by the Polish Ministry of Foreign Affairs (MSZ) or the competent regional courts of appeal. This authenticates the signature of the Polish authority on the document, but does not replace the sworn translation: the two procedures are distinct and complementary.

Sworn Polish translation in Belgium

Contrary to what many Polish residents believe, the certified translation you need in Belgium must be carried out by a Belgian sworn translator, not by a tłumacz przysięgły (Polish sworn translator). A Polish sworn translator is recognised before Polish courts and administrations, but their certifications have no legal value in Belgium.

In Belgium, sworn translators are registered with a Court of Appeal (Brussels, Liège, Ghent, Antwerp or Mons) and have taken an oath of faithfulness. Their translations are accompanied by an official attestation bearing their signature and stamp, which gives them legal value before all Belgian administrations.

For European citizens such as the Polish, the situation is slightly more flexible than for nationals of third countries. Regulation (EU) 2016/1191 requires Member States to accept certain civil status documents accompanied by the standard EU multilingual form without sworn translation. However:

• This regulation only applies to a limited number of documents (birth, marriage and death certificates, civil status) and not to diplomas, criminal records or other professional documents
• Some Belgian municipalities continue, out of administrative habit, to require sworn translation even for documents covered by the regulation
• For procedures at the Immigration Office or the SPF Interior for naturalisation, sworn translation is always recommended to avoid any delay

When in doubt, the safest solution remains having a sworn translation carried out: it is accepted in all cases, whereas a multilingual form without translation may be refused by certain authorities.
