The Belgian frontier worker pension in Luxembourg: two bodies, two logics

Any Belgian frontier worker who has contributed in Luxembourg for at least one year is entitled to a Luxembourg pension. It is the Centre national des pensions (CNAP), based in Luxembourg City, that manages the calculation and payment of the Luxembourg pension. In parallel, the Belgian Office national des pensions (ONP/ONSS) calculates the Belgian pension based solely on periods of work completed in Belgium.

The two pensions are independent: you receive them separately, potentially into two different accounts, and they are subject to separate tax declarations. The Luxembourg pension is taxable in Luxembourg (withheld at source), while the Belgian pension is taxable in Belgium. Retired frontier workers must therefore continue to manage their binational tax situation after retirement, sometimes until the end of their lives.

European social security coordination law (Regulation EC 883/2004) applies to prevent gaps and double contributions. The periods totalisation rule allows each fund to take into account insurance periods completed in the other country when calculating pension entitlement, even though the amount paid by each fund is calculated proportionally to the periods completed in that country.

Periods totalisation: how it works in practice

Imagine you worked 15 years in Belgium and 20 years in Luxembourg. To calculate your Belgian pension, the ONP examines whether your 15 Belgian years alone entitle you to a full pension. If not, for example because the minimum number of required years has not been reached, the ONP can "totalise" your Luxembourg years to determine whether you are entitled to a pension, then calculate the amount taking only the 15 Belgian years into account (pro-rata method).

For the ONP to totalise your Luxembourg periods, it must receive an official document from the CNAP certifying those periods. That is the role of the SED P5000 form (mixed career certificate). If this form contains annotations in German, or if your file includes supplementary supporting documents issued by former Luxembourg employers, a translation will be needed for the Belgian ONP to process your file correctly.

How to request and use your Luxembourg career record

You can request your CNAP career record at any time, not just as retirement approaches. It is good practice to check it every five years to ensure all your working periods are correctly recorded. The request can be made online via the MyPension.lu portal or by post to the CNAP (12, rue Erasme, L-2013 Luxembourg).

The record you receive lists your contributory periods, your credited periods (illness, unemployment, maternity leave), and your annual reference earnings. If any periods are missing, you must report them to the CNAP with supporting documents from former employers, which may also be in German if the company was German-speaking.

When you present this record to your Belgian retirement adviser, your health fund, or a financial adviser to simulate your overall pension, it is strongly recommended to have a complete French translation. Belgian advisers are not trained in CNAP vocabulary, and misunderstandings about the nature of periods (contributory vs credited) can lead to incorrect pension projections.

Practical steps when retiring from a Luxembourg employer

If you retire directly from a position in Luxembourg, your Luxembourg employer will give you several documents upon departure. These include the employment certificate (Arbeitszeugnis in German for German-speaking companies), the final settlement statement, and an end-of-contract certificate. These documents may be requested by the Belgian ONEM if you go through a period of unemployment before your actual retirement date, or by your health fund to validate your entitlements.

The Luxembourg pension application must be filed with the CNAP at least three months before your intended retirement date. The Belgian pension application is submitted simultaneously to the ONP. The two bodies communicate directly with each other through standardised European forms, but supplementary documents in a foreign language may be returned to you for translation.

It is advisable to start the process 12 months before your intended retirement date, particularly for frontier workers with complex mixed careers involving breaks, self-employment, or part-time work. Processing times at the CNAP can reach four to six months for the most complex files.
