Divorces Pronounced in an EU Member State: Brussels IIb Regulation
Since 1 August 2022, Regulation (EU) 2019/1111 (known as "Brussels IIb") applies to divorce judgments rendered in EU Member States. This regulation provides for automatic recognition of these judgments within the EU: a divorce pronounced in France, the Netherlands, Spain, or Germany does not need an exequatur procedure to be recognised in Belgium. Simply producing the judgment and, if necessary, its certified translation into French or Dutch is sufficient for updating the Brussels civil register.
Divorces Pronounced Outside the EU: Exequatur or Homologation
For divorces pronounced in third countries (Morocco, Turkey, Algeria, Tunisia, the Democratic Republic of Congo, etc.), two routes exist in Belgian law. The first is the exequatur procedure before the Brussels Court of First Instance, which gives the foreign judgment binding force in Belgium. The second is direct transcription to the civil register, possible when the conditions of the Belgian Code of Private International Law are met (notably the absence of contradiction with public policy).
