The three pathways to Belgian nationality

The Belgian Nationality Code was significantly reformed by the Act of 4 December 2012 (in force from 1 January 2013), which strengthened integration requirements. Three articles structure access to nationality:

  • Article 12bis BNC — declaration of nationality: the standard pathway, open after 5 years (or 10 in some cases) of legal continuous residence, with proof of linguistic, social and economic integration. Decision by the municipal civil registrar, with review by the Public Prosecutor.
  • Article 12 BNC — acquisition by a child: for children born in Belgium to foreign parents, subject to lawful residence of the parents.
  • Article 24 BNC — naturalisation: exceptional pathway granted by the Chamber of Representatives for special merits (sportspeople, artists, scientists rendering services to Belgium). Only a few dozen cases per year.

Article 12bis: detailed document checklist

Article 12bis BNC is the route taken by 95% of applicants. The declaration is made at the municipality of residence (civil registrar), who forwards the file to the Public Prosecutor. The review period is 4 months, extendable. Required documents:

  • Foreign birth certificate with Hague apostille (or consular legalisation), sworn translation into FR/NL/DE.
  • Criminal record extract from the country of origin and from any country of residence since age 18 (less than 6 months old), apostilled and translated.
  • Proof of linguistic integration: minimum CEFR A2 in French, Dutch or German, or Belgian secondary diploma in one of these languages, or completed integration course (parcours d'intégration in Wallonia/Brussels, inburgering in Flanders).
  • Proof of social integration: recognised diploma, vocational training of 400 hours, or validated integration course.
  • Proof of economic integration: 468 days of work as employee or self-employed (main activity) over the past 5 years (social contributions).
  • Recent family composition issued by the municipality.
  • Marriage certificate and birth certificates of children if family life is reconstituted in Belgium.

Real cost of the naturalisation procedure

The costs of an Article 12bis declaration consist of:

  • Federal registration fee: €150 to be paid to the SPF Finances before submission (Article 238 of the Registration Duties Code).
  • Municipal fees: variable, generally between €0 and €50 depending on the municipality.
  • Sworn translations: €200 to €500 depending on the number of documents (birth certificate, criminal record, sometimes diploma, marriage, children's birth certificates).
  • Apostilles or consular legalisations: variable, free in some countries (Morocco), paid elsewhere.
  • Language tests if no diploma: SELOR test (free) or municipal language test.

For a single applicant, the total ranges from €400 to €750. For a family with children to include, expect double.

SPF Justice timelines and pitfalls

The Public Prosecutor has 4 months (extendable by 2 months) to issue an opinion. Without a negative opinion within the deadline, the declaration is recorded in the nationality register and the applicant becomes Belgian. A negative opinion can be challenged before the Family Court within 15 days.

The most common reasons for rejection: incomplete criminal record (forgetting an intermediate country of residence), translation not sworn or done by a translator not registered with the RNEJ, failure to meet the 468-day work requirement.

How long does an Article 12bis procedure take?

The official deadline is 4 months after complete submission at the municipality, extendable by 2 months. Allow 5 to 8 months in practice, depending on the workload of the Prosecutor's Office in your district (Brussels is generally slower than Liège or Charleroi). If the opinion is negative, add several months for any appeal to the Family Court.

What language level is required for Belgian nationality?

CEFR Level A2 (basic user) in French, Dutch or German. It can be proven by a recognised diploma (Belgian diploma in one of these languages, diploma issued by an official training operator), a SELOR Level A2 test, or validated attendance of an integration course. A foreign diploma must be translated and recognised through NARIC or CFWB equivalence.

Do I need a criminal record from EVERY country I have lived in?

Yes. The Public Prosecutor requires a criminal record extract from each country where you have resided for more than 6 months since the age of 18. This is the number one omission in rejected files. If you have lived in France, Germany, Morocco and Belgium, you need four criminal records, all dated less than 6 months, apostilled and translated.

Is my foreign diploma recognised for integration purposes?

Not automatically. To serve as proof of linguistic or social integration, the foreign diploma must first be recognised by NARIC-Vlaanderen or by the French-speaking Community (CFWB Equivalences Service). The sworn translation of the diploma and academic transcript is mandatory for this recognition procedure.
