Apostille and Sworn Translation for Kosovar Documents in Belgium

The Kosovar community is one of the largest Balkan communities in Belgium. A wide range of administrative procedures (marriage, naturalisation, municipal registration, recognition of a diploma) require Kosovar documents that have first been authenticated and then translated. As Kosovo is a party to the Hague Apostille Convention, these documents can in principle receive an apostille, followed by a sworn translation into Dutch or French. The apostille: Kosovo and the Hague Convention

Kosovo has acceded to the Hague Convention of 5 October 1961abolishing the requirement of legalisation for foreign public documents. In practical terms, a Kosovar public document can therefore receive an apostille issued by the competent Kosovar authority, rather than a multi-step consular legalisation. The apostille is a standardised certificate confirming the authenticity of the signature and seal affixed to the document.

One point should be approached with care: Kosovo's status is not recognised uniformly by all states, and some authorities may apply specific practices regarding the recognition of Kosovar documents and apostilles. The most commonly requested Kosovar documents in Belgium

• Civil-status records: birth, marriage and death certificates, essential for municipal registration, marriage or naturalisation.

Languages: Albanian, sometimes Serbian, and transliteration of names

Official Kosovar documents are most often drawn up in Albanian, and sometimes in Serbian depending on the issuing authority or the period. To be usable in Belgium, these records must undergo a sworn translation into Dutch or French, carried out by a sworn translator listed on the Belgian national register of judicial experts and sworn translators.

One essential technical point is the transliteration of proper names. Kosovar first names and surnames may appear in differing spellings from one document to another. The three steps of the procedure

• Step 1 - Apostille in Kosovo: have the apostille affixed to the original document by the competent Kosovar authority before sending or bringing the document abroad.
• Step 2 - Sworn translation in Belgium: a registered sworn translator translates the apostilled document into Dutch or French, depending on the region and the receiving authority. The apostille itself is usually included in the translation.
• Step 3 - Submission to the Belgian authority: submit the apostilled document together with its sworn translation to the municipality, the public prosecutor, the university or the Immigration Office.
