The Dutch Burgerlijk Wetboek: Specificities Compared to Belgian Law

The Burgerlijk Wetboek (BW) is the Dutch Civil Code, progressively modernised since 1992. While the Dutch BW and the Belgian Civil Code share common historical origins (the Napoleonic Code), they have evolved distinctly since Belgian independence in 1830. Dutch contract law, for example, is structured differently: Book 6 of the BW (Verbintenissenrecht) uses its own terminology and concepts that do not always correspond directly to Belgian Civil Code notions.

Among the significant terminological differences, note the concept of wanprestatie (failure to perform an obligation, comparable to inexécutionin Belgian law but with procedural nuances), the distinction between onrechtmatige daad (tortious liability, Article 6:162 BW) and toerekenbare tekortkoming (contractual liability), or the regimes of opschorting (suspension) and ontbinding (termination or rescission of the contract). These terminological nuances have real legal implications and cannot be translated by simple analogy without risk of distorting the meaning.
