After entering the Netherlands with an MVV, the applicant must obtain a verblijfsvergunning(residence permit) from the IND. There are several types of verblijfsvergunning depending on the applicant's situation:

  • Verblijfsvergunning regulier voor bepaalde tijd: temporary residence permit (generally 1 to 5 years) for workers, students and spouses of residents.
  • Verblijfsvergunning regulier voor onbepaalde tijd: permanent residence permit, granted after 5 years of continuous legal residence.
  • Verblijfsvergunning asiel: refugee status or subsidiary protection for asylum seekers.
  • EU-verblijfsvergunning voor langdurig ingezetenen: EU long-term resident status, granted after 5 years of legal residence in any member state.

Gezinshereniging (family reunification) and naturalisatie in the Netherlands

Gezinshereniging (family reunification) allows family members of a legal resident in the Netherlands to join them. The procedure involves the family member residing in the Netherlands (the referent) submitting an application to the IND to bring their spouse, minor children or parents. Conditions include sufficient financial resources on the part of the referent and adequate accommodation.

The civil status documents of the family member concerned (birth certificate, marriage or partnership certificate) must be presented in Dutch or English, or accompanied by a certified translation. If the documents come from countries whose authenticity is difficult to verify, the IND may request an authenticity check (onderzoek naar de echtheid van documenten).

For naturalisatie (acquisition of Dutch nationality), the requirements are stricter. In addition to 5 years of continuous legal residence, a Dutch language level (inburgeringsexamen) and social integration, the applicant must provide a complete file including their apostilled and translated birth certificate, proof of residence, a criminal record extract from the country of origin and, in certain cases, a document proving renunciation of original nationality. Which documents must be translated into Dutch for the IND?

The IND accepts documents in Dutch, English, French and German without translation. For any other language, a certified translation is mandatory. If your documents are in French or Dutch (as is often the case for Belgian nationals), they are directly acceptable without translation. However, if you have documents in other languages (Arabic, Turkish, Polish, Spanish, Portuguese, etc.) in your file, these documents will need to be translated into Dutch or English by an RBTV-certified translator.

For French-speaking or Dutch-speaking Belgian nationals submitting files to the IND, the good news is that their civil status documents in French or Dutch are directly readable by IND staff. Does the IND accept documents in French without translation?

Yes. The IND accepts documents written in Dutch, English, French and German without requiring translation. If you are a French-speaking Belgian national and your civil status documents are in French, you can submit them directly to the IND. However, if your file contains documents in other languages (for example, documents from a spouse who is a national of another country), an RBTV-certified translation will be required for those specific documents.

How long does the naturalisatie procedure take in the Netherlands?

The Dutch naturalisatie procedure generally takes between 12 and 24 months from the submission of the complete application. The IND has a legal processing deadline but actual timescales can be longer in periods of high demand. It is therefore important to submit a complete file from the outset, with all necessary certified translations. How do I prove my family relationship for a gezinshereniging application?

Yes. The Belgian criminal record extract (model 2 or 3, depending on the IND's requirements) can be translated into Dutch or English by our agency.
